1. What information do we collect?

Personal information you disclose to us

In short: We collect personal information that you provide to us.

We collect information that you voluntarily provide to us when you register on our App, express interest in obtaining information about us or our produces and Services, when you participate in activities on our Website (such as posting comments or entering contents), or otherwise when you contact us.

The personal information that we collect depends on the context of your interactions with us and our Website and App, the choices you make, and the products or features you use. The personal information we collect may include the following:

Personal Information provided by You. We collect names, gender, phone numbers, email addresses, schools, mailing addresses, billing addresses, and other similar information.

Payment Data. We may collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. Payment history is stored by our Service and Fovea, and payment data is stored by Apple and Google. Information automatically collected

In short: Some information – such as your Internet Protocol (IP) address and/or browser and device characteristics – is collected automatically when you use our App or visit our Website.

We automatically collect certain information when you visit, use, or navigate the Website and when you open, use, or navigate the App. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, session information, information about how and when you use our Services, and other technical information.

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Website or App, which we record in log files.   • Facilitate account creation and logon process. We use your email and created password to facilitate account creation and future logon authentication to provide the App and our Services to you. In addition, if you choose to link your account with us via a third-party account (such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process.
  • Request feedback. We may use your information to request feedback and to contact you about your use of our Services.
  • Enable user-to-user and Service-to-user communications. We may use your information in order to enable user-to-user or Service-to-use communications with each user’s consent.

8. Do we collect information from minors?

In short: We do not knowingly collect data from or market to children under 13 years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using our Services, you represent that you are at least 13 years old or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of our Services. Account Information

If you would – at any time – like to review or change the information in your account or terminate you can:

  • Log into your account settings and update your user account

Upon your request to terminate your account, we will deactivate your account. We will delete all information as per your request or updated settings from our active databases. However, we may retain some information – such as your account creation timestamp, date when the account was deleted, and purchase data – to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use, and / or comply with applicable legal requirements.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove or reject cookies, this could affect certain features or services of our Website.

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the email that we send or by contacting us using the details provided below. You will then be removed from the marketing email list. 10. Controls for Do-Not-Track features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting that you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

11. Do California residents have specific privacy rights?

In short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users (who are California residents) to request and obtain from us information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year, once a year free of charge. If you are under 13 years of age, reside in California, and have a registered account with our Services, you have the right to request removal of unwanted data that you publicly post or provide to our Services. Will your information be shared with anyone else?

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf.

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be selling of your personal data.

Sportwatch LLC has not disclosed or sold any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. Sportwatch LLC will not sell personal information in the future belonging to website visitors, app users, and other consumers.

Your rights with respect to your personal data

Right to request deletion of the data – Request to delete

You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have information in our system. These verification efforts require us to ask you to provide personal information so that we can match it with the information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you previously provided us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Based on the applicable laws of your country, you may have the right to request access to the personal information we collect from you, change that information, or delete it in some circumstances.
